• Handle product samples and displays with care

1. Liability

• Zeds is not liable for any accidents, injuries, or loss of personal property within the showroom premises
• Customers are responsible for their personal belongings at all times

1. Photography & Recordings

• We may photograph or video the showroom and customer interactions for promotional, training, and quality assurance purposes
• If you prefer not to be filmed or photographed, please inform our staff immediately upon arrival

1. Product Samples

• Larger fabric samples or cut pieces (e.g., 1 meter or more) are considered “Custom Cut” purchases and are non-refundable
• All samples remain the property of Zeds unless purchased

8. MEASUREMENT DISCLAIMER

Zeds provides complimentary in-home measurement services as a professional courtesy to our customers.

1. Measurement Responsibility

• Final measurements are verified and approved by the customer before production begins
• Zeds takes full responsibility for measurement accuracy only when:
  • Our team performs the on-site measurement, AND
  • The customer has approved the measurements in writing (email/WhatsApp/signed form), AND
  • Production is based exclusively on those approved measurements

1. Customer-Provided Measurements

• If a customer provides their own measurements, Zeds is not liable for any fitting issues, gaps, or installation problems arising from incorrect customer-provided dimensions
• Any adjustments required due to incorrect customer measurements will be treated as a new order and charged accordingly

1. Verification

• We strongly recommend that customers allow our trained professionals to perform all measurements to ensure accurate fit
• Measurements provided during consultation are estimates only until physically verified by our team

9. INSTALLATION SCHEDULING & ACCESS POLICY
10. Scheduling

• Installation dates are confirmed via phone/WhatsApp at least 48 hours in advance
• Customers must confirm availability and provide any special instructions before the scheduled date

1. Site Access Requirements

• Customers must ensure:
  • Full access to all installation areas
  • Clear pathways free of furniture, obstructions, or hazards
  • Adequate parking near the premises for our installation team’s vehicles
  • Availability of electricity and water if required
  • Adults (18+) present during installation to grant access and approve work

1. Rescheduling & Cancellation

• If our team is unable to access the site due to:
  • Customer unavailability or no response
  • Locked premises without prior arrangements
  • Denied or unavailable parking
  • Unsafe site conditions

…a rescheduling fee of ₹500 may apply for the next visit.

• Cancellations must be communicated at least 24 hours before the scheduled time to avoid fees

1. Pre-Existing Conditions

• Our team will exercise reasonable care during installation but is not liable for pre-existing wall, ceiling, or floor conditions (e.g., cracks, weak plaster, uneven surfaces, hidden wiring/piping)
• Any damage caused by our team during installation will be repaired at our expense

1. Clean-Up

• Our team follows “dust-free” installation practices and will clean up after completing the work
• Customers are responsible for final deep cleaning if desired

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

1. No Indirect Damages
   Zeds shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to:

• Your use or inability to use our website
• Any products purchased from us
• Installation delays or service interruptions
• Manufacturer-related decisions or product recalls
• Any errors or omissions in website content

1. Maximum Liability
   In no event shall Zeds’ total liability to you for all claims exceed the amount paid by you to Zeds for the specific product or service giving rise to the claim.
2. Manufacturer Responsibility
   For branded products (mattresses, tracks, motors, etc.), Zeds acts as an authorized retailer and facilitator. Manufacturer warranties and liabilities are governed by the respective brand’s terms.
3. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Zeds, its owners, directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

1. a) Your violation of these Terms of Use
   b) Your use or misuse of our products, services, or website
   c) Your violation of any third-party rights, including intellectual property rights
   d) Any false or misleading information provided by you
   e) Any disputes between you and third parties arising from your use of our products
2. RIGHT TO REFUSE SERVICE

• Customer conduct violates applicable laws or regulations
• Customer behavior is harmful, threatening, abusive, or disruptive to our employees, other customers, or business interests
• The customer has provided false or misleading information
• The customer has unpaid dues from previous transactions
• Fulfilling the order would violate a law or cause us to incur liability

We are not liable to you or any third party for any refusal, termination, or cancellation of service under this section.

13. FORCE MAJEURE

Zeds shall not be held liable for any delay or failure in performance of our obligations arising out of causes beyond our reasonable control, including but not limited to:

• Acts of God (floods, earthquakes, cyclones, fires, natural disasters)
• Government restrictions, orders, or regulations
• Strikes, lockouts, labour disputes, or unrest
• Pandemics, epidemics, or public health emergencies
• Transportation delays, fuel shortages, or logistics failures
• Supplier failures, material shortages, or manufacturing disruptions
• Power outages, network failures, or technical issues beyond our control
• Civil disturbances, riots, or acts of terrorism

In such events, our obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to resume performance as soon as practicable.

14. SEVERABILITY

If any provision of these Terms of Use is found to be unenforceable, illegal, or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No modification or amendment to these terms shall be binding unless in writing and signed by an authorized representative of Zeds.

Nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law.

17. GOVERNING LAW & JURISDICTION

These Terms of Use shall be governed by and construed in accordance with the laws of India.

Any dispute, controversy, claim, or disagreement arising out of or relating to these Terms, your use of our website, or any transaction with Zeds shall be subject to the exclusive jurisdiction of the courts in Mangalore, Karnataka, India.

You irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue or inconvenience of forum.
